Terms and Conditions of Third-party Communication Channels of Hong Kong Life

Once you use third-party communication channels to communicate with Hong Kong Life Insurance Limited ("Hong Kong Life", "we" or "us" hereafter), you shall be deemed to have read, understood and agreed to all of the Terms and Conditions as set forth herein. If you do not agree to these Terms and Conditions, you must not use third-party communication channels to communicate with us.

  1. Third-party communication channels include but are not limited to WhatsApp, Messenger, Instagram and WeChat. Hong Kong Life reserves the right to suspend or terminate the use of any third-party communication channel or change the function of the third-party communication channel at any time without prior notice.
  2. Users' personal data is collected and processed by Hong Kong Life in accordance with the Personal Data (Privacy) Ordinance. On or before collecting personal data, Hong Kong Life will provide the individuals concerned with a Personal Information Collection Statement informing them of the purpose of collection, classes of persons to whom the data may be transferred, their rights to access and correct the data, and other relevant information.
  3. The use of third-party communication channels is subject to the privacy policies and terms of service of the relevant service providers of the third-party communication channels.
  4. You acknowledge that these channels may not be available for use at all times, and may be subject to interruption, failure of hardware or software, errors, transmission blackout, delayed transmission due to internet traffic or incorrect data transmission due to the public nature of the internet, market volume or volatility, system failure or upgrades or maintenance or for other reasons. To the maximum extent permitted by applicable law, Hong Kong Life shall not be liable for any failure to carry out user's online instructions, or any inaccurate or untimely transmission of information, or any data breach or leakage, or any use of information by any third-party communication channel, or any errors, omissions, damages or losses, which are attributable, wholly or in part, to any causes beyond the control of Hong Kong Life including but not limited to any technical malfunction or failure. To the maximum extent permitted by applicable law, under no circumstances shall Hong Kong Life be responsible to the users for any direct, indirect or consequential losses arising from or in connection with the carrying out or not carrying out of the user's online instructions.
  5. The use of third-party communication channels by Hong Kong Life is mainly intended to provide customers with general information on products, offers, services, events, and games.
  6. The use of third-party communication channels by Hong Kong Life is not intended to answer personalized customer enquiries. For enquiries from existing customers of Hong Kong Life about policies and account details, please call the Hong Kong Life Customer Service Hotline at (852) 2290 2882 or send an email to HongKongLifeCS@hklife.com.hk.
  7. Please DO NOT send sensitive personal information through the third-party communication channels. Hong Kong Life will not ask for any sensitive personal information, account information, password, or credit card information through third-party communication channels.
  8. You agree that you will not use third-party communication channels to communicate with us in any way that is unlawful or infringes the rights of others.
  9. All products, promotions, services, events, and game information provided by Hong Kong Life through third-party communication channels are subject to relevant terms and conditions. For details, please refer to Hong Kong Life's website. The information is for reference only, is published in Hong Kong only, and should not be interpreted as an offer, solicitation, or recommendation to offer or sell or solicit the purchase of any Hong Kong Life product outside Hong Kong.
  10. Where Hong Kong Life knows of or suspects a breach of security or other suspicious circumstances in respect of or in connection with the operation of one or more of the third-party communication channels generally, Hong Kong Life may, in its absolute discretion and without any liability to the maximum extent permitted by applicable law, refuse to act on or delay acting on the instruction and in that event, Hong Kong Life will, to the extent possible, inform you as soon as practicable.
  11. Hong Kong Life's information and materials provided via third-party communication channels are owned by Hong Kong Life and/or its licensors. Hong Kong Life grants you a non-transferable, non-exclusive license to use Hong Kong Life's information and materials provided via third-party communication channels, subject to these Terms and Conditions. You may download Hong Kong Life's information and materials contained in third-party communication channels for your personal, non-commercial use. You may not amend, alter, make addition to or deletion of the information and materials or use them for any commercial purposes, including but not limited to any sale or rental or public display of the same. You agree to prevent any unauthorized copying and / or transferring of the information and materials. Hong Kong Life retains the sole and absolute right, at any time, to terminate your use of third-party communication channels if you are in breach of the Terms and Conditions stated herein, without prior notice. To the maximum extent permitted by applicable law, Hong Kong Life's information and materials are provided on an "as is" and "as available" basis without any representation or warranty of any kind, whether express or implied.
  12. These Terms and Conditions shall be governed by and construed in accordance with the laws of Hong Kong SAR. You agree that the courts of Hong Kong SAR shall have [exclusive] jurisdiction over any disputes arising out of or in relation to these third-party communication channels and/or these Terms and Conditions.
  13. We may assign and transfer our rights and obligations under these Terms and Conditions to another organization, but this will not affect your rights or our obligations under these Terms and Conditions.
  14. Without prior written consent from Hong Kong Life, you may not transfer your rights or obligations under these Terms and Conditions to another person.
  15. If any provision or part-provision of these Terms and Conditions is or becomes invalid, illegal, or unenforceable, it shall be deemed deleted, but that shall not affect the validity and enforceability of the rest of these Terms and Conditions.
  16. These Terms and Conditions and any document expressly referred to in it constitute the entire agreement between the parties relating to the use of third-party communication channels. You agree that you shall have no remedies in respect of any statement, representation, assurance or warranty (whether made innocently or negligently) that is not set out in these Terms and Conditions, or any document expressly referred to in it.
  17. If we fail to insist that you perform any of your obligations under these Terms and Conditions, or if we do not enforce our rights against you, or if we delay in doing so, that will not mean that we have waived our rights against you and will not mean that you do not have to comply with those obligations. If we do waive a default by you, we will only do so in writing, and that will not mean that we will automatically waive any later default by you.
  18. Hong Kong Life reserves the right to amend these Terms and Conditions at any time without further prior notice. Please check for updates to the content of these Terms and Conditions regularly to decide whether to continue to use third-party communication channels to communicate with us.
  19. These Terms and Conditions are applicable within the Hong Kong SAR only.

The Chinese version of these Terms and Conditions is for reference only. In case of any conflict between the English version and the Chinese version, the English version shall prevail.
